I have the full custody of my two children, we are currently in the family law system, and I have been granted the custody order by the dependency system. There is a 10-year restraining order (criminal) in effect due to comprehensive DV.
We were assigned a different judge for the upcoming Covid 19 proof hearing. We had a court date back in December, and the judge declined to alter custody, but gave the father and the proof hearing unmonitored visits (hesitantly) but said he had a right to do so.
After December, I’ve lost something, and I’ve had to move, or I’m going to be homeless once this rent moratorium lifts.
My custody order notes that “If a parent wishes to transfer a child’s residence for more than 30 days, the parent must give 45 days notice to the other parent so that adequate mediation and adjustment of visitation can be discussed”
I gave notice to my ex and his solicitor. He did not file an RFO that didn’t tell me about the transfer, nor did he file an ex parte file. Rather, he filed a statement and added it to this upcoming case due to the transfer and requested a change of custody. It’s a moving day today. Ok, I’m afraid. Our court date is five days later, and I’m going to transfer by then. Will I be all right?
